Free, as is, yours to keep.

Parker is a free, open-source tool made by one person and shared with the world. These are the terms for using it — the Mac app, the iPhone app and this site. By installing or using Parker you agree to them.

What Parker is

A text editor for a folder of plain files, provided by Manoel Lemos ("we", "us") free of charge. The Mac app is distributed as a direct download; the iPhone app through Apple's TestFlight and App Store. The source code is published on GitHub under the MIT License, which governs the code itself; these terms govern the apps as you install and use them.

Beta software

Parker is a personal project in active development. It may change, break, behave unexpectedly or stop being maintained at any time, without notice. Features may be added or removed between versions. There is no service level, no support commitment and no promise of future updates.

Your notes are yours — and so are your backups

Everything you write in Parker stays in files you own, in a folder you chose. We never have a copy. That also means you are responsible for backing them up: use a sync service, Parker's Git sync, Time Machine, or all three. A bug, a crash, a sync conflict or a mistake of your own can lose or corrupt files, and nothing in Parker can restore what it never stored.

No warranty

Parker is provided "as is" and "as available", without warranty of any kind, express or implied — including, without limitation, the implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that Parker will be accurate, reliable, uninterrupted, error-free or secure, or that it will meet your needs.

Limitation of liability

To the fullest extent permitted by law, we are not liable for any damages arising out of or related to your use of, or inability to use, Parker — including loss of data, loss of profits, loss of work, business interruption, or any indirect, incidental, special, consequential or punitive damages — whether in contract, tort or otherwise, even if we were advised of the possibility. Where liability cannot be excluded, it is limited to the amount you paid for Parker, which is nothing.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages; in those places the above applies only as far as the law allows, and nothing here removes rights you have as a consumer that cannot be waived.

Third-party services

Parker can work with services you choose — iCloud Drive, Google Drive, Dropbox, GitHub or any git remote. Those services are governed by their own terms and are not ours; we are not responsible for what they do with your files, for their availability, or for conflicts and losses that originate in them. Apple's TestFlight and App Store have their own terms, which you accept with Apple.

Acceptable use

Use Parker lawfully. Don't use it to store or distribute content you have no right to, and don't try to break it for other people. The MIT License already lets you copy, modify and redistribute the code; these terms don't take that away.

Privacy

What Parker does with your data — which is nothing — is on the privacy page. It is part of these terms.

Changes to these terms

We may update these terms as Parker evolves. The date below changes when they do, and the page is versioned with the rest of Parker on GitHub. Continuing to use Parker after a change means you accept the new terms.

Governing law

These terms are governed by the laws of the State of California, United States, without regard to its conflict-of-law rules, except where the law of your country of residence necessarily applies to you as a consumer. Any dispute that cannot be resolved informally will be brought in the courts of San Francisco County, California.
